The Impact of Testamentary Documents in a Divorce: a Divorce Attorneys’ Perspective

In this program we will explore misconceptions in divorce, mainly how one’s testamentary plans
may actually play out in the process. We will examine the concerns to weigh when the parties
have trust assets (marital, separate, or hybrid property). We will discuss how testamentary
documents may not completely shield a party’s assets from a claim for equitable distribution,
spousal and child support, and attorneys’ fees and costs. We will analyze how a party’s actions
before, during, and after divorce may impact the ultimate treatment of their assets and
liabilities.
Natalia Wilson is a Principal and Managing Partner of Ain & Bank, P.C., serving clients in DC, MD,
and VA. She is a trusted personal advisor with over a decade of experience in all aspects of
matrimonial and family law. She represents a range of individuals, including clients in high net
worth cases involving business valuations, businesses held in trusts and other estate planning
vehicles, and interstate child custody and support matters. In addition to her practice, Natalia
has been entrusted to manage the hiring needs and financial matters of the firm. She is a Fellow
of the American Academy of Matrimonial Lawyers and an Adjunct Faculty member of American
University- Washington College of Law. She has been quoted and featured in major publications,
such as the New York Times and Essence Magazine. She has also been listed in Best Lawyers In
America, Super Lawyers and currently serves as a member of the Board of Directors for the
Women’s Bar Association Foundation, the Fairfax Law Foundation, University of Virginia College
